A) SEASON TICKETS

CONDITIONS OF ISSUE

1. The ticket is issued subject to the Rules, Regulations and Byelaws of The National League, Football Association Limited, CHELMSFORD CITY FOOTBALL CLUB.

2. The ticket admits the holder to National League South home matches at Chelmsford City Football Club on production of the season ticket at the appropriate entrance.

3. Holders must produce the Season Ticket/ticket at the turnstile.

4. Tickets are non-transferable and can not be re-sold to third parties, further to this, tickets can not be used as a prize in a lottery, competition or newspaper, without prior written consent of Chelmsford City Football Club, or the event organiser where applicable. The Season Ticket/ticket will be confiscated and cancelled without compensation if used by anyone other than the person in whose name it is registered. All season ticket sales are full and final, refunds are not applicable on season tickets. Any misuse of a season ticket will result in the season ticket being removed.

5. The Club will not accept any responsibility whatsoever if the Season Ticket is lost, stolen, damaged or destroyed and duplicate tickets will not be issued, unless in exceptional circumstances. If issued an admin charge of £5 will be charged.

6. The Club cannot guarantee that a Season Ticket holder will be able to reserve a specific seat for matches other than First Team League matches for the season that the ticket is valid. However, the Club shall endeavour to give the Season Ticket holder priority to their allocated seat, subject to time constraints, for other matches whenever possible. The Season Ticket holder’s seat is not guaranteed from season to season.

7. Season Ticket holders are advised to take their seats at least 15 minutes before the scheduled start of each home First Team match.

8. Season Ticket holders are required to observe the Ground Regulations currently in force, copies of which are displayed outside the stadium and on our website. Breach of any Ground or FA or League regulations may result in the season ticket being withdrawn.

9. No person may bring into the stadium or use within the stadium any equipment which is capable of recording or transmitting (by digital or other means) any audio, or audio visual material or any information or data in relation to a match or the stadium.

10. Racism and discrimination will not be tolerated by the club under any circumstances.

11. The use foul and abusive language, obscene, racist and/or discriminatory language and/or gestures; directed at any player, staff or official will be ejected from the ground immediately.

12. Spectators who wish to purchase, or who hold, a concessionary ticket, may be required to produce evidence of their entitlement to such a ticket.

13. Any spectator found to be in breach of any of the Ground Regulations will be ejected from the ground and may face a ban from the club premises.

B) HOME MATCH TICKETS

CONDITIONS OF ISSUE

1 Issue of Home Match Ticket

1.1 The issue of a Home Match Ticket and subsequent access to the Ground is subject to the Terms & Conditions of Entry (which can be provided upon written request to the Club).

1.2 Home Match Tickets are for the use of supporters of the Club only.  By applying for the Home Match Ticket and/or using the same you hereby warrant and represent that you are a supporter of the Club and/or that you are not a supporter of the Visiting Club.

2. Admission to the Ground

2.1 By purchasing and/or accepting and/or holding a Home Match Ticket and/or using  a Home Match Ticket to gain access to the Ground, you: (a) certify that you have read, understood and accepted; (b) agree to be bound by and to comply with; and (c)  agree to bring to the attention of others, as required below, the Terms & Conditions of Entry.

2.2 A Home Match Ticket permits you to occupy at the Match the seat if available. The Club have also set up some areas as ‘unallocated seating’ and spectators can sit or stand anywhere in these areas.

2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Home Match Ticket in any subsequent Match or season.

2.4 Save as set out in clause 2.5 below, you shall not bring into (or use within) the Ground any equipment that is capable of recording or transmitting (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to the Match or any aspect of it. Any person acting in breach of this provision may have such equipment confiscated and/or will be required to deliver up any tapes, films, disks or other recordings or data to the National League and/or the Club and the copyright in any such recording or transmission is hereby assigned (by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988) to the National League and/or the Club.

2.5 Mobile telephones are permitted within the Ground, provided that they are used for personal and private use only.

2.6 Save for official Club merchandise and/or other football related clothing worn in good faith, you shall not bring into, use or display within the Ground any sponsorship, promotional or marketing materials.

2.7 You shall not offer or distribute (either free or for sale by any person) within the Ground any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 2.6 above where both the content and the publication are lawful in all respects and do not in the Club’s reasonable opinion constitute a threat to public order.

2.8 The Club reserves the right to refuse admission to, or eject from, the Ground any person who fails to comply with the Terms & Conditions of Entry.

2.9 Without prejudice to the representation at clause 1.2, above, and in light of the Home Match Ticket holders being grouped together in designated areas, any attempt to gain access to the Ground wearing or carrying apparel (including, without limitation, hats and/or scarves) that demonstrate support for the Visiting Club, may result in admission being refused or you being ejected from the Ground and in such circumstances no refund or alternative seat will be offered.

3. Use of Home Match Ticket

3.1 Subject to clause 3.3, below, the Home Match Ticket is issued for your sole use and you shall not sell, assign or transfer the Home Match Ticket or the benefit of it to any other person without the prior written consent of the Club. The reference to selling the Home Match Ticket includes offering to sell a Home Match Ticket (including, without limitation, via any online auction website), exposing a Home Match Ticket for sale, making a Home Match Ticket available for sale by another and advertising that a Home Match Ticket is available for purchase. For the avoidance of doubt (and by way of example only) this Home Match Ticket may not be offered as a prize in any promotion or competition; transferred, lent or sold to any third party as part of a hospitality or travel package; given to a third party who agrees to buy some other goods or services; or used for any other commercial purpose (all save as expressly authorised by the National League or the Club).

3.2 The unauthorised sale or disposal of a Home Match Ticket may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. The Club will inform the police when it becomes aware that a Home Match Ticket has been sold illegally and will press for charges to be brought against those breaking this law.  If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, we will notify the National League who may in turn notify other clubs and/or the relevant law enforcement authorities.  The information that we share may include your personal details, information about the offence and about ticket purchases (including payment details).  We will use this to identify and prevent ticket touting offences and disorder at matches.

3.3 If more than one Home Match Ticket is issued to you, one Home Match Ticket must be retained by you, for personal use (subject to the provisions below) and the remainder may be transferred to your Guest(s) for his/her/their personal use only  PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party’s business. Such transfer to any Guest will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3 below) apply to and bind each Guest as if he/she was the original purchaser of the Home Match Ticket (and you must inform the Guest(s) of this).  You will provide the name and address of your Guest(s) when asked to do so by any official, steward or employee of the Club and/or SMC and/or any police officer.  In the event that you and/or your Guest(s) are unable to use any Home Match Ticket then you may transfer that Home Match Ticket(s) to a natural person who is known to you personally and who would be entitled (under the Terms & Conditions of Entry and otherwise) to purchase such Home Match Ticket and attend such Match PROVIDED THAT such transfer takes place in consideration of no payment or benefit in excess of the face value of the Home Match Ticket, and such transfer does not take place in the course of any business or for the purpose of facilitating any third party’s business.  Such transfer will be subject to the Terms & Conditions of Entry which will (save for any rights to transfer under this clause or any rights to a refund under clause 4.3 below) apply to and bind the transferee as if he were the original purchaser of the Home Match Ticket (and you must inform the transferee of this).  You will provide the name and address of the transferee when asked to do so by any official, steward or employee of the Club and/or SMC and/or any police officer.

3.4 The Home Match Ticket will remain the property of the Club at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of the Club or SMC or any police officer.  The Club reserves the right to require the immediate return of the Home Match Ticket at any time.

3.5 Any Home Match Ticket obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Home Match Ticket shall be nullified. Any person seeking to use a Home Match Ticket in breach of the Terms and Conditions of Entry in order to gain entry to the Ground or remain at a Match may be considered to be a trespasser and may be refused entry to, or ejected from, the Ground in respect of a particular Match and/or may have his/her  Home Match Ticket cancelled or withdrawn. In the event of any cancellation and withdrawal in accordance with this clause 3.5, no refund shall be payable. The Club further reserves its right to take any legal or disciplinary action against any person(s) as it sees fit in connection with such matters, including a claim for an account of any profits made from an unauthorised use of a Home Match Ticket.

4. Changes to Dates, Refunds & Exchanges

4.1 No guarantees can be given by the Club that the Match will take place at a particular time or on a particular date. Subject to clause 4.2, below, the Club reserves the right to reschedule any Match without notice and without any liability whatsoever.

4.2 In the event of the postponement or abandonment of the Match (or if the Match has, for any reason, to be played out of view of the public), you will be entitled to receive a full refund (including any booking and/or administration fee) or receive the equivalent ticket for the subsequent re-arranged Match via such application procedure as the Club stipulates.  The Club will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.

4.3 In order to obtain a refund, the Home Match Ticket must be returned to the Club’s ticket office no later than 24 hours before the commencement of the rearranged Match. A refund will only be issued on production of identification that the individual requesting the refund is the person to whom the Home Match Ticket was originally sold. For the avoidance of doubt, the final decision belongs to the Club.

4.4 Tickets purchased for games that have not been postponed or abandoned are refundable provided that the tickets are returned to the Ticket Office at least 24 hours prior to the advertised kick off time. Tickets returned after this time will only be refunded in extenuating circumstances, as decided by the Club. No refunds will be given for tickets returned after a game that has been played under any circumstances.

5. Lost or Stolen Home Match Tickets

5.1 In order to gain admission to the Ground, the Home Match Ticket must be presented in its entirety at the Match.

5.2 The Club shall not be obliged to issue any replacement for a lost, stolen or destroyed Home Match Ticket.

6. Cancellation & Withdrawal of Home Match Ticket

6.1 Without prejudice to any other remedies it may have, the Club shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel and withdraw any Home Match Ticket issued to you. Any breach of Ground Regulations can also result in cancellation and withdrawal of any Home Match Ticket.
In the event of such cancellation no refund will be paid.  Without prejudice to the general nature of the above, the following actions shall constitute serious breach of the Terms & Conditions of Entry:

6.1.1 smoking in designated non-smoking areas;

6.1.2 being (or appearing to be) drunk or intoxicated;

6.1.3 persistent standing in seated areas whilst the Match is in progress;

6.1.4 The sale or transfer of a Home Match Ticket to any person;

6.1.5 the deliberate misuse of a Home Match Ticket;

6.1.6 any misrepresentation in relation to clause 1.2, above;

6.1.7 the possession of a banner or flag that bears material or slogans that are offensive, obscene, abusive or discriminatory.

6.1.8 the throwing of any object within the Ground that may cause injury or damage to people or property without lawful authority or excuse;

6.1.9 the use foul and abusive language, obscene, racist and/or discriminatory language and/or gestures; directed at any player, staff or official will be ejected from the ground immediately;

6.1.10 the chanting of anything of an indecent, discriminatory or racist nature;

6.1.11 fighting, or engaging in and/or inciting violence;

6.1.12 the use of the C word in any shape or form will also result in ejection from the ground;

6.1.13 bringing any of the following into the Ground (or using them within the Ground): illegal drugs; other illegal substances; fireworks; firecrackers; smoke canisters; air horns; flares; laser devices; bottles; glass vessels or any item that might be used as a weapon or compromise public safety;

6.1.14 entering the playing area (home or away) or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;

6.1.15 the supply of any misleading or incorrect information in any application;

6.1.16 any breach of clauses 2.4 or 2.5, above; and

6.1.17 any failure to pay or default of payment in respect of any sums owing to the Club (or any third party) in respect of any Home Match Ticket.

6.2 If a Home Match Ticket holder is not 16 years old or over, his/her parent(s) and/or guardian(s) are responsible for his/her actions, conduct and compliance with the Terms and Conditions of Entry.

6.3 Children under 2 years old are not allowed entry into the ground on matchday.

6.4 In the event that your Home Match Ticket is withdrawn or cancelled the Club reserves the right to exclude you from any membership scheme maintained or organised by the Club and/or to disqualify you from applying for any Match ticket or season ticket at its discretion and to notify FIFA, UEFA, The Football Association, The Football League, The National League and/or other football clubs of such exclusion and/or disqualification (and the reason(s) for such exclusion and/or disqualification).

7 Filming, photography and taping

7.1 All Home Match Ticket holders who enter the Ground acknowledge that photographic images and/or video recordings (and/or stills taken from video recordings) may be taken of them and may also be used in televised coverage of the game and/or for promotional or marketing purposes by the Club, the National League or others, and use of a Home Match Ticket to enter the Ground constitutes consent to such use.

8 Exclusion of Liability

8.1 The Club and SMC hereby excludes any liability for loss, injury or damage to persons/property in or around the Ground except in respect of death or personal injury resulting from any negligence of the Club or Stadium Management Company.

8.2 Neither the National League nor the Club nor the CCFC/SMC shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (i) the position of the seat and/or (ii) the actions of other spectators.

9 General

9.1 The invalidity or partial invalidity of any provision of these Conditions of Issue shall not prejudice or affect the remainder of these Conditions of Issue, which shall continue in full force and effect.

9.2 The Club’s failure to exercise, or delay in exercising, any right, power or remedy provided by these Conditions of Issue or by law shall not constitute a waiver of that right, power or remedy.

9.3 The Terms and Conditions of Entry constitute the entire agreement between the Club and the Home Match Ticket holder and neither the Club nor the Home Match Ticket holder shall have any claim or remedy in respect of any statement, representation, warranty or undertaking made by or on behalf of any other party in relation to the Terms and Conditions of Entry which is not set out therein.

9.4 Notwithstanding any other provision in these Conditions of Issue and with the exception of FIFA, UEFA, The FA, the Football League, and National League no other person other than you or the Club or the SMC has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue.  Nothing in these terms of conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

9.5 These Conditions of Issue and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales in relation to any dispute or claim arising out of or in connection with these Conditions of Issue (including in relation to any non-contractual disputes or claims).

10 Definitions

In the Conditions of Issue the following words and phrases shall have the following meanings:

  • “Club” means Chelmsford City Football Club.
  • “Conditions of Issue” means these terms and conditions governing the issue and use of a Home Match Ticket.
  • “Ground” means the football stadium and all other locations owned, occupied or utilised by the Club.
  • “Ground Regulations” means those ground regulations issued by the Club from time to time that set out the terms and conditions upon which spectators are granted entry to the Ground.
  • “Guest” means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Home Match Ticket under the Terms & Conditions of Entry.
  • “Home Match Ticket” means a printed paper ticket or any other form of ticket (and/or any rights arising out of or in connection with any of the foregoing) for admission to the Match.
  • “Match” means that National League football match in which the Club participates and that takes place at the Ground as designated upon the ticket to which these Conditions of Issue apply.
  • “SMC” means Stadium Management Company.
  • “Terms & Conditions of Entry” means each of the rules and regulations of FIFA, UEFA, The Football Association, The Football League (“EFL”), and National League; the Ground Regulations; and the Conditions of Issue.
  • “Visiting Club” means the football club playing against the Club.

  1. INTRODUCTION
    1.1 The terms and conditions on this page, together with our Privacy Policy, apply to your participation in the My Clarets membership Programme.(‘Programme’) 
    1.2 The promoter of this activity is  Chelmsford City FC (“we”, “us”, “our” or “Promoter” as applicable). You can find our company and contact details at the end of these Terms.  
    1.3 Please read these Terms carefully as by entering the Programme, you will be deemed to have accepted and agreed to be bound by them.
    1.4 We recommend that you print a copy of these Terms for future reference. You can contact us in relation to the Programme or request a copy of these Terms by writing to us using the contact details at the end of these Terms
    1.5 Please note that if your entry to this Programme is successful and you will be required to carry out certain activities and comply with certain requirements and obligations set out below. We will ask you to confirm that you are able to fulfil these requirements and obligations.  If it becomes apparent that you are unable to comply with them–whether before or after we reserve the the right to disqualify you from the Programme and require you to return the membership card in accordance with these Terms.

  2. ELIGIBILITY AND PARTICIPATION

2.1 You must accept the the membership scheme by signing up and providing a live email address. Instructions contained within the email invitation and within the timescale stated and to accept these terms and conditions. 
2.2 To be eligible to participate in the Programme you must:
2.2.1 be aged 11 or over (we will not accept entries from you if you are under the age of 11 unless you provide parental consent);
2.2.2 be resident in the United Kingdom;
2.2.4.2 accept delivery of the your digital membership card.
2.3  not be an employee and any members of your family and/or household must not be an employee of the following 
2.3.1 any company or organisation involved in or connected to the Programme;
2.3.2 any advertising agency or digital media or web services provider connected with the Programme;
2.3.3 any affiliate or group company of the companies mentioned in paragraph 9;
2.4 By entering the Programme, you promise that all information submitted by you is true, accurate, current and complete. We reserve the right to verify your eligibility to enter the Programme prior to, during and/or after any product review campaign.

8.1 All copyright and other rights, webform data and other materials you submit to us in connection with this Programme (“Submitted Materials”) are the property of the Promoter and you hereby transfer to us all such rights in all media for the whole term of the Programme. (including any extensions or renewals to that term). Accordingly, you hereby irrevocably and unconditionally waive any moral rights or similar rights you have in your participation in the Programme. 

  1. OUR LIABILITY

9.1 If we (or our supplier) fail to comply with our obligations to you under these Terms, we are not responsible for loss or damage you . 

9.2 We only provide a membership scheme. You agree not to copy or provide your card details to anyone else.
9.4 We are not responsible for any interruption or disruption to or technical malfunctions of any telephone network or lines, electronic devices, systems, servers, providers, websites or computer equipment or software, failure of any email or entry to be received due to technical failures or traffic congestion on the internet, on telephone lines or at any website, or any combination of these, including any injury or damage to your or any other person’s device related to or resulting from participation or downloading any materials in the Programme.
9.5 We do not accept any responsibility for any material in your entries that is defamatory, which infringes the intellectual property rights of any third party or that is otherwise unlawful.

  1. PUBLICITY AND YOUR PERSONAL DATA

10.1 We reserve the right to use and feature your Username, for publicity purposes and/or in connection with any of our advertising, promotional or marketing activities as stated in our Ratings and Reviews Terms and Conditions.
10.2 Chelmsford City FC take care how information about you is used and shared and we appreciate your trust in us to do that carefully and sensibly.

When you enter this Programme, we will ask you to input and will collect Personal Information from you such as your name, e-mail address, date of birth, home address, mobile telephone number. All the information that we collect will be subject to our Privacy Policy which governs our collection, use of information and purpose for which we use that data. Please, see our Privacy Policy for further details. You understand that by entering the Programme My Clarets we will collect and use your personal details as described in the Privacy Policy, which includes promoting loyalty scheme, offers, prizes directly to you.

  1.   OTHER IMPORTANT TERMS

11.1 Our decision is final and no correspondence on any matter concerning the Programme will be entered into.
11.2 If any part of these Terms is found to be unenforceable as a matter of law, all other parts of these Terms will not be affected and shall remain in force.  For the avoidance of doubt, should these Terms or any part of them be deemed void or voidable, this shall not affect the validity of any transfer of rights provided under these Terms.
11.3 We intend to rely on these written Terms and any document expressly referred to in them in relation to the subject matter of any contract between us.  We and you will be legally bound by these Terms.
11.4 In these Terms, words that appear after the expression ‘include’, ‘including’, ‘other’, ‘for example’, ‘such as’ or ‘in particular’ (or any similar expression) will not limit the meaning of the words appearing before such expression.  
11.5 You may not assign, sub-license or otherwise transfer any of your rights under these Terms.
11.6 If you breach these Terms and we choose to ignore your breach, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms again.
11.7 These Terms do not create any right enforceable by any person who is not a party to them.

  1. CHANGES TO THE PROGRAMME OR THESE TERMS

12.1 We may at our sole discretion modify, suspend or terminate the Programme, extend its closing date or time or make any other changes to the Programme or Terms.
12.2 Where reasonably possible, we will notify you of such changes in advance or at the time we make such changes by posting amended Terms on this page.

  1. EVENTS OR CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL

13.1 If we are prevented or delayed from complying with our obligations under these Terms by anything you (or anyone acting on your behalf) does or fails to do or due to events or circumstances beyond our reasonable control (including fire, flood and other acts of God, strikes, trade disputes, lock outs, restrictions of imports or exports, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war) our inability or delay in performing our obligations will not be deemed to be in breach of these Terms.

  1. GOVERNING LAW AND JURISDICTION

14.1 The Programme and these Terms are governed by English law and any disputes are subject to the exclusive jurisdiction of the courts of England. 
14.2 We make no representation that materials relating to the Programme are appropriate or available for use at other locations. Access to those materials from territories where their contents are illegal is strictly prohibited. If you access the Programme from outside of the United Kingdom, you are responsible for compliance with all local laws.

  1. COMPANY AND CONTACT INFORMATION

The Promoter of the Programme is Chelmsford City FC, a company incorporated in England registered under company registration.

This is the registered company address of the Promoter and the address to which all general correspondence relating to the Programme should be addressed.

Miscellaneous

These terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales. The courts of England will have exclusive jurisdiction for any dispute arising under or in relation to them.
